In
the event that a court ruling in a divorce or other family law
legal dispute does not go your way, this does not mean you must
sit by and simple accept the family courts decision.
Just as in other areas of law,
divorce and family law allows for an individual to seek to have a
judges ruling appealed.
A family law appeal may usually only be filed after the family
law judge issues his or her final order, which is a legally
binding court order which is meant to resolve specific family
law issues or disputes. Because every case is unique, it is
important to seek experienced legal counsel to discuss whether
you have grounds for a family law appeal and whether it makes
sense to file for a review.

Those who choose to contest a family law court ruling must
officially file an appeal with the appropriate Court Of
Appeals. You must file the appeal in the
district which has jurisdiction in the county in which your
family law case occurred.
Contrary to popular belief, an appeal in not a new trial,
but rather a forum in which you and your attorney / lawyer
must persuade the court of appeals that the existence of
legal errors occurred during the course of your trial, and that
because of those errors, the family law court ruling should be
reversed.
The first act in the appellate
process is to file the
"Notice Of Appeal". This document officially informs
the trial court and opposing counsel of your intent to appeal
the family law ruling. The next step is to request that the
family law trial court "transmit
the record" of the trial level proceedings, and that
you be provided a copy of the
transcript. As your legal counsel, we may initially
argue on your behalf in what is known in what is known as an
"appellate brief."
